In the state of Florida, there are many complicated laws surrounding divorce and legal separation, and many issues often arise that require the insight of an experienced divorce lawyer in Orlando, FL.

There are two cases in which a divorce will be granted in this state:

  1. The marriage is irretrievably broken
  2. One party is mentally incapacitated

An irretrievable breakdown simply means that the marriage cannot be fixed. Once you and your spouse agree on this term, your attorney will help you file an affidavit under oath and the judge will hold a hearing anywhere from 90 days to six months later. In filing the affidavit, you may be required to give evidence and examples of the marriage breakdown.
