Domestic Violence Under Florida Law
Under Section 741.28 of the Florida Statutes, domestic violence is defined
as any assault, aggravated assault, battery, aggravated battery, sexual
assault or battery, stalking or aggravated stalking, kidnapping, false
imprisonment, or any criminal offense that results in physical injury
or death of a family member or household member by another family or household
member. A family or household member includes:
- A spouse
- A former spouse
- A person related by blood or marriage
- People who presently live together as if a family
- People who have lived together in the past as a family
- People who have a child in common, regardless if they were ever married
In Florida, the victims of domestic violence can petition for an injunction
for protection against domestic violence (restraining order). This is
a civil order that provides protection from abuse by a family or household
member. This court document orders the abuser to stop doing certain acts
such as abusing you or your children, contacting you, or coming near you.
It can also order an abuser to leave your home or start paying you temporary
child support. It can also give you certain rights such as temporary
custody of your children.
