Florida is a Judicial Foreclosure State
In the state of Florida, the government requires banks to go through judicial
foreclosure. This means the bank who holds your mortgage has to file a
lawsuit against you in order to foreclose on your house. When a bank decides
to foreclose, a few things will happen in succession:
- First, you will receive a 30-day notice to warn you that the bank plans
to foreclose on you
- Then, you will be notified (or “served”) the legal action being
taken against you, as in any other lawsuit.
- The court gives you 30 days to respond and, if you wish to do so, contest
the foreclosure action. (If you contest your case, a hearing or hearings
will be necessary, which would extend the amount of time you have left
before your home is sold, assuming you do not prevail.)
