Take Charge of Your Legal Situation by Contacting Richard A. Heller, P.A.
In the state of Florida, there are many complicated laws surrounding divorce
and legal separation, and many issues often arise that require the insight
of an experienced lawyer in Winter Park, FL.
There are two cases in which a divorce will be granted in this state:
- The marriage is irretrievably broken
- One party is mentally incapacitated
An irretrievable breakdown simply means that the marriage cannot be fixed.
In most cases, it is simply a mutual agreement between both spouses that
their marriage is not working, and they are not interested in putting
in any effort any longer. Once you and your spouse agree on this term,
your attorney will help you file an affidavit under oath and the judge
will hold a hearing anywhere from 90 days to six months later. In filing
the affidavit, you may be required to give evidence and examples of the
Proof of Marriage Breakdown
These examples could include any of the following:
- Financial difficulties
- Significantly differing interests
- No mutual concern for emotional needs
- Resentment and distrust
- Prolonged physical separation
You and your spouse will be required to make agreements on the other elements, such as division of property. If children are present, you will also
need to make arrangements for custody, support, and visitation. There
are other issues that will inevitably arise, and because of this, you
need to make sure that you have a legal representative on your side that
can help you traverse these difficult topics and help you prepare a better future.
